Fincas on rustic land: what buyers should know about legalisation

Many fincas have extensions, pools or guest houses without full permits. Since 2025 Mallorca has a time-limited procedure to legalise them.

The issue

On rustic land, the suelo rústico, building is strictly limited. Over the decades, many extensions were nevertheless built without a permit or in breach of it. What a brochure shows is therefore not always what legally exists.

The extraordinary legalisation

In 2024 the Balearics created an extraordinary legalisation procedure. The Consell de Mallorca has applied it since its publication in the official gazette on 15 February 2025. Applications can be made for three years.

  • Condition: the period in which the authorities can order demolition must have expired.
  • Cost: a levy to the municipality based on the construction cost of the unpermitted parts: 10% in the first year, 12.5% in the second, 15% in the third. Architect and fees come on top.
  • Requirements: measures to improve energy or water efficiency.
  • Important for rentals: legalised living space may not be let to tourists. This is recorded in the land registry.

In practice the cost deters some owners. For certain houses, however, legalisation and its cost can be well worth it, because it raises the value considerably.

What this means for buyers

Before buying, it should be checked whether land registry, cadastre and what is actually built match, and which parts are permitted. If legalisation is needed, its cost and any restrictions on holiday rental belong in the price negotiation.

I can have houses on rustic land checked by an architect before purchase. Your lawyer provides the legal assessment of the individual case.
